Article 22 of the GDPR is the key provision governing AI automation in businesses. However, the term “automated individual decision-making” is not clearly defined. Does it start with a calculator? Are we regulating mathematics? In order to further develop Article 22 GDPR into a practical and meaningful safeguard for data subjects, it is time to clarify the terminology.
