Collective claims are emerging as a powerful new enforcement mechanism for digital rights. This allows alleged violations affecting millions of users to be brought before courts in one single proceeding. But what does it actually take to build such a case — and what makes collective litigation fundamentally different from traditional privacy enforcement? Are there any relevant global proceedings (like the US Meta-case) that affect us here in Europe - and how?
Drawing on current mass claims involving major digital platforms, this conversational session takes participants behind the scenes of collective enforcement. It explores how cases are built, which legal and procedural questions determine their success, and what privacy professionals can learn from the issues that ultimately become litigation risks. The session will be an interview between our speakers and during the conversation they invite you to join with your input and questions.
